so call it that. You dont have equitable interest, you have a lien. So get an attorney to draw up a mortgage and record that. As far as the clerk is concerned, a confused mind always says no.

Your state allows for trust deeds instead of mortgages. They are usually far better off for the lender. You may want to do this instead. See an attorney.

I gave someone a small loan secured by a promissory note. They agreed that I could record a “MEMORANDUM AND AFFIDAVIT OF EQUITABLE INTEREST” on their property to quasi-protect my interest when they when to refi it in a month.

I went to file the “MEMORANDUM AND AFFIDAVIT OF EQUITABLE INTEREST” on the property here in Orange County, Ca. The Clerk rejected my filing cite that there was “NO PROVISION TO RECORD THIS DOCUMENT”.

I am shocked because I have filed this doc in Los Angeles County. Any ideas? Thanks.
