Hi. I’d like to ask that, after signing the selling contract with Seller who get financial problem. I try to assign the contract to another investor for assignment fee. My question is who is going to pay for the title search,escrow closing fee and execise tax? Thank you for your information.

It can be done 1 of 2 ways with pros and cons for both:

  1. Your Buyer/Assignee pays. The problem with this is that if there are any surprises that kill the deal (i.e. title problems), you end up looking like you don’t know what you’re doing. You also diminish the chance of getting a return call from the Buyer/Assignee on your next deal.

  2. You pay. Of course, this means you come out of your pocket with up front money. However, you get to make sure that title is clear and everything is ready to close. You speed up the time is takes your Buyer/Assignee to close (because he doesn’t have to run title) and become known as a good wholesale supplier of deals.

I usually go with option #2, after having gotten burned by option #1 a couple of times.
