I’m planning an exchange. I will be trading an apartment building for a larger one. I am aware of certain criteria for a valid exchange, i.e. 1) I do not get any debt relief; 2) my new equity must not be less the equity I’m trading.
My question: Do I still need to “balance the equities”?
I know there have been some changes in the legal procedure over the years. It will be much easier if I do not somehow have to force the equities to be equal at the time of the trade. Can somebody shed some light? Much appreciated.
