Come back on another day when that person isn’t working. Seriously, there is nothing that prevents you from recording the memorandum other than a pinhead at the county. I’ve heard the same thing in CA, that some counties will allow and some won’t, and that in the same county, sometimes you can and sometimes you can’t.
I have attempted to file an Affidavit and Memorandum of Agreement Concerning Real Estate in order to protect our rights on a house that we lease/optioned. The county recorder here in Fresno, Calif told me that we could not record this without the signature(notarized) of seller. I’ve recorded these Memorandums in other counties with just my signature(notarized). He claims Gov’t Code sections 27229 and 27280 prevent him from recording our document here. Any ideas on how to handle? I have 30+ more that I would like this of protection/leverage on here.
