Darren,
you should put it on both contracts. For others around the country Massachusetts is only one of two states which uses two separate contracts. The first is the Offer to Purchase presented by the Buyer to the seller and after negotiations are completed this contract is signed. The seller is then given a period of time to prepare the purchase and sales agreement which is then presented to the buyer. From what I have seen from the other 48 states it all the same language just basically split into two separate but related contracts. I do not know where the other state is that uses 2 contracts but i would like to hear if anyone knows

When using the “and/or assigns” in a contract, is it generally written into the offer to purchase or the
purchase and sale agreement?

In the Purchase Contract, in the blank with your name as buyer. I am assuming the “offer to purchase” you refer to is a letter of intent, and not a contract.
