I always opt for NO arbitration, expecially forced arbitration. If I am the seller I want the contract to state that the buyer looses his earnest deposit and or down payment, if he does not perform. I am not interested in getting into an arbitration senario where the buyer may be able to get some or all back.

When selling a property FSBO, and a buyer comes in with a agent, using a broker’s purchase agrement, as seller should I opt for arbitration/mediation, or not?
