If you have a binding contract, the Broker might have the right to hold you to the listing agreement, but might well release you if you go to him and just explain your situation.

I wouldn’t want an unhappy client so early on, and it would be my inclination to accomodate you. Might be that Broker would do the same.

At any rate, tell the Broker you’d please like a copy of the agreement you signed and you’ll probably get one easily.

We recently sign a contract to list our house with an agent with the
agreement that we would not list for another 2-3 weeks until we have
the house ready to list. 3 days after we sign, we discovered that
a member of our family could list the house for us for a lot less
commission than the agent we just signed. Can we legally cancel this
contract if our house is not listed yet? We don’t even have the
copy of the contracts since it was so new.
