“As is, where is” usually means that the owner will not fix or repair anything. A unit that is not rent ready because it needs repairs would not be a reasonable interpretation of “as is”. Normal business activities could be considered: collecting of rent, sending of notices, routine maintenance (trash, light bulbs, mowing grass and the like). It would not reasonable include: painting interiors of units, replacing carpets, and so on. The later are repairs and would not be included in an “as is” sale.

Dear Sir,

A contract for apartment is under escrow and stated that is sold “as it and where is condition”,however,there is a clause in the contract that states that owner needs to perform normal business acitivites.

Question: Is getting current vacant units “rent ready” consider normal busienss activities of the current owner?
What if current owner not willing to get the vacant unit “rent ready.”
