  1. full and accurate disclosure of both parties. it must be specific. John DeLoreon’s prenupt was tossed becasue he said he had “some real estate in California”. He had some $20million dollars of real estate in California.
  2. each party must have independent counsel. you can use the same attorney and your partner should use an attorney that you have never used, didn’t go to school with you or have any relationship to insure unbiased and unconflicted interests.
  3. It must not be under duress. You can’t say hear sign this as your marching down the aisle. Even a week or month before the nuptials may be under duress.

Can a Limited Partnership or LLC be used as a Post-Nuptual device in order to fix the ownership interest of each partner-spouse and protect against loss of control in the event of divorce?

If you are not in a community property state, wouldn’t ownership by “Joint Tenancy in the Entirety” accomplish this?

I don’t know for sure, just asking.
