I have done thiis twice, both times because the seller seemed to want to back out. It didn’t even show up on the title search either time. I did show one of the sellers the affadavit though, and that stopped them from even pursuing it any further.

In my limited experience they make a better threat than an actual cloud.

I’ve only done it twice, could be that I was just unlucky. Who knows?

what forms you can record. I tried to file a memorandum to cloud title and they would not allow it. In my county, here in Oregon, they will not record anything that does not have both parties listed, signed, and notorized.

They also didn’t like the title Bronchick used on the top of the memo.

They did tell me that if it was titled Memorandum of Option Agreement and the sellers and the buyers signed it, and it was notorized they would have recorded it for me. The cost here is $15 a page I believe.
