Gates broke. Took them down HOA refusing to replace. Saying replacement is not the same as repair They want a 2/3 vote for special assessment to replace.

The HOA runs the show, and apparently, they’re saying they have to follow bylaws. And if you’re not happy with things, you can pass around a petition, or run for a seat on the HOA.

From a practical standpoint, they probably budgeted very little for repairs, and if anything breaks, there’s no money. That’s a guess.

I lived in a condo once, all young money tight owners, and the answer to assessments, increase in monthly fees is NO NO NO. Money and reseves were spent on emergency repairs.

So one time, an emergency meeting was called, and a special assessment was needed to pay the “gas bill”, eight months behind. The gas company was going to cut it off in the middle of the winter.

My view at the time was, that they should have higher fees, rather than to make special assessements.

The HOA should hold meetings, and at least an annual one, and perhaps you should attent to see what’s going on.

gated communities are like country clubs. the HOA runs the show. they set monthly dues in an effort to maintain the streets, landscaping, gate, pay the security guards, etc. but when non-recurring exenditures are required, guess what? the HOA can and WILL assess the owners to pay for it. just like a country club that needs to re-build greens or make other major expenditures.

read your HOA rules and they should be very clear.
