Even asking for permission can reveal a great deal. When originating a transaction it is best to ask for it and important to do so. Technically, when extending credit, you have a right, but it is a bit of a controversial area. Even in the secondary market (buying an existing note) it is still best, when it won’t lead to some kind of commissiondectomy - the payor connecting with the seller and cutting you out of the transaction.

I have an option to purchase a mechanic’s lien, and want to check the debtor’s credit to help determine their ability to pay. Can I (legally) check the debtor’s credit without their permission?

I always get permission to do a credit check when selling a mobile home on a note. Does this mean I don’t really need that permission or does it mean that I just don’t need it later when I’m selling the note?
