Lorna, tell your friend to file disposessory warrant/eviction immediately and send written notice to tenant (or have attorney do it, if she’s not comfortable)!!!

Hello all,

My friend Mary purchased a house through pre-foreclosure some months ago and now she can’t get rid of the seller.

She paid the house off…small balance and agreed to give the seller some walking around money. The seller wanted the money up front, Mary said no. Mary saw that the seller was dragging her feet about moving so she told her she would charge her $1k per month rent. The seller agreed. Now the money has ran out and still Mary can’t get the seller to move. The latest is that the seller wants 5 more days.

What is Mary’s next move?

Be wary of the seller filing bankruptcy. There is a good chance your deal could be undone by the courts.
