I have a L/O tenant that has been late every month and I have had to track him down to get it as he never returns calls or anything. And now this month after I finally got a check from him it has now been returned. I am in Va. can someone tell me how soon you can evict and the process.

And yes I will screen better next time but this was for my first L/O deal and I just wanted to make it happen. Learning from the school of hard knocks

Call a local real estate attorney. He will save you time and $$. I never do my own evictions. As for how soon you can evict… that depends on state law and your lease/rental agreement.
My rent is due on the 1st, late on the 5th. On the 5th a 5 day notice goes out. I generally send a 2nd notice around the 15th (although I could evict at that point). At that point, I go to the lawyer.
