In NY state the abstract and or title is customarily paid by seller in some counties and by buyer in some counties.I am in the eastern part of the state so i do not know about Rochester but if you called the county clerks office they can tell you what is customary.That does not mean it cannot be negotiated.I have not had to do a survey on a sale in years but unless there was a reason it needed to be done because of title issues i would tell the buyer to pay it if it is due to their choice of financing or just because they wanted it.

I live in Rochester, NY and am selling a house. The real estate agent told me that I, as the seller, am responsible for paying for the instrument survey and the abstract. I thought those were expenses the buyer would incur. Without a clause in the contract, who would be responsible for these expenses?
