Use the Bronchik–it is pro-seller and Sheets is pro-buyer (unless you’re buying and then use Sheets). You could also make your own. Pick some from this and some from that–merge the documents. Better still, get a lawyer to draw one up.

My partner and I are having differences of opinion when it comes to a rental property we both own. He wants to use a Carleton Sheets lease option agreement which is pro-buyer. I want to use a Bronchick lease option agreement which is pro-seller. My question is, if he gets the tenant/buyer to sign and he/she moves in without my signature, can I have this person removed?

That would depend on what type of entity you are using I would think.

If it calls out that you both have the same powers, as in partners, then yes he could most likely sign the lease. You would not be able to move them out.

Even if you could would you want that fight? If they can show you are partners then I would think they have a good fight to put up.

Get a lawyer and ask them, and get a new partner if you are fighting over someting as simple as a lease.

I would throw him, and Sheets, out.
