Have you thought of posting this over at www.legalwiz.com and let Bronchick address it. I am sure that he has an answer for this one.

Best of luck to you and Betsy,

L/O, Assignments, and Power of Attorneys - Posted by GregNorman

I got a call last night from a landlord/seller where I assigned a lease option contract between my company and he and his wife to a tenant/buyer about a year ago. They were happy then and are very happy now b/c the new t/bs are looking to purchase here in couple of weeks.

Unfortunately, the l/s lives on the west coast, wife is going out of country for a month starting next week, and they don’t have any relatives in the area. They called me to see if I could close it for them. They figured they would just send some Power of Attorney documents to me and I could handle everything for them.

  1. Is there any type of conflict of interest (b/c of the assignment, where I was the t/b at one point)?

  2. They want to pay me for signing as their attorney in fact with their POA. Is that legal for me to do that?

  3. If they can pay me, how much should I charge?
