A friend of mine came across a 40 acre tract of land that has been for sale for 4 years and the owners only want 79,500 for it. Their only advertisement is a hand make sign beside the road that is barely visible. The lot prices and the location make this a very, very good deal or so it seems. My friend wants 10 acres and we thought we could partner on the rest and subdivide. The folks selling the land are three siblings who inherited the land. The sibling trying to sell the land says that it is stipulated that the land cannot be subdived for x many years. Is a stipulation in a will enforceable on the people who buy the land from those who inherited it or would that have to be stipulated in another document with the local govt? I have a feeling this is why the land has not been sold in 4 years. She almost seems as if she does not want to really sell the land. has anyone ever run into a situation like this?
