Bud,

Are you saying that, in Texas, the trustee himself MUST be named as the new owner on the deed and that the trust CANNOT be named as the new owner on the deed?

Or is this just one way of doing it in Texas?

Thanks.

When transferring title to a Land Trust, who is named as the new owner on the deed, the name of the trust or the name of the trustee?

In Colorado, the trust. You also file a “Certificate of Authority” or a “Trustee’s Affidavit” with the County stating the name and address of the trustee.

I just realized that the answer could depend upon the state. I need to establish 2 trusts, one in Colorado and one in Texas.

In Texas I use the deed to contain the information that could be put on a separate certificate. The individual as trustee is the title holder. Filing the first page is $9 and $2 for each additional page. Takes me 4 pages for the deed to trustee.
