Joe, this is a legal question but I figured you’d be better qualified to answer it than the legal forum. My attorney is telling me that in Georgia, mechanic’s liens are not assignable – at least not until the lien has been “perfected” and become an actual judgement. I’ve looked in the Georgia code myself and there’s nothing that says they are assignable one way or the other – but it does say liens in general are assignable. I’m thinking that it’s just something that hasn’t been done in Georgia before, so the attorneys don’t have any legal precedents to to safely say that they are assignable.
Do you know if this has been a problem for people working your system in Georgia or other states? Please advise, thanks.
