Yes, here in VA they can. They can recover the lot rent owed from the time the park notifies the lien holder that their buyer’s are delinquent on lot rent. They cannot make you pay for the lot rent owed before this notification, however, they can require you to pull the MH out of the park if the back lot rent is not also paid by someone.

Usually if you work with the PM, this is not a problem. When buying homes with delinquent lot rent, you can often get the PM to discount what is owed.

If the lot rent is on a home which you are already a lien holder, it only makes wise business sense to work quickly and closely with the PM to get the lot rent performing. We essentially guarantee the lot rent will be paid. This makes the PM’s much more comfortable working with us and our buyer’s of less than perfect credit.

I just found this site and need some help.

Can a owner of a mobil home park take the lein holders to court to recover lot rent.

Owner has taken home owner to court and won judgement.
Knows he will most likely never collect.

Now is suing lien holder for all rent due by owner.

Can this be done?
