I sold a house last spring, and took back a second. The buyer is to pay me 50.00 per month. He is now in arrears 80.00. I tried to call him and his phone is disconnected. I also know he is getting a divorce, or has just gotten one.

Do I have a right to call the first mtg and see if he is current or not? As a second lien holder? Do they have to tell me?

Yes…you have the right. They may want some documentation, like a copy of your deed of trust. Give them a call.
