No, we are currently in New York trying to get them out. So far what I have found out from the Village Attorney is that I have to file trespassing charges against them at the local police department.

The police department says that they will have them arrested for trespassing and will escort them off of the property. At this point I am going to change the locks and put in my security system and call it a day.

This is our 2nd NY property and we are currently moving to NY.

I just bought a preforeclosure property in NY last week. The tenants who reside there are legally not my tenants. I went to the court to file papers to have them legally evicted and was told that they are squatters not tenants. Therefore they are trespassing and to use the Sheriff’s office to arrest them.

The Sheriff’s office has informed us that we need to go through the court system. We just want to get them out. What can we do?

No, just kidding.
In a case like this, especially with NY’s reputation for “Tenants rights”, I’d call a good eviction service or attny FAST!
Get them out of the way.
Then again, you may try to offer them a little cash to get out NOW and then change the locks etc.

Whatever you do, go by the law, or you can and probably will pay more for this later,

HI,
I had a similiar problem, it cost me a hundred bucks, for the woman to leave no questions asked. She departed my property with her belongings and held a street sale which netted her another hundred bucks. I don’t know what your situation is but, this may be worth a shot. Lots O’ Luck!!

This is an area that I just do not understand, but if someoen takes possession of your property and is living in the home, without a lease. You have to go through the proper procedres to have them removed from the property. For the life of me I don’t think I will ever understand this, but you can not throw them out, the sherrif can not arrest them. You must file in court, wait for your date, prove they are squatters, get a court order then call the sherrif to come evict them.
If the electric in the home is on in your name, technically you can have it shut off.

You could do things such as updating the electrical system and having them stop half way through the job and not come back, take the doors off of the home and taken somewhere to be repainted (doors take a very long time to dry), perhaps shutting the water off may work. But all to often is someone is just willing to move into your home these annoyances may not bother them.

I almost - but not quite - had to deal with a similar situation (I backed out of the deal after becoming aware of the squatters). My understanding from the local officials was that it would be necessary to appear in the local village court and bring an unlawful detainer action, after which the judge would issue an order of eviction - which the sheriff would then be obliged to enforce.

It may be necessary to use an attorney, especially if you are handling this from MD. If the property is anywhere near me (I am in central NY) I might be able to give you some recommendations.

Hate to admit it, but you may need a lawyer who knows his way around the system. I’ve heard that NY is one of those places that isn’t particularly “landlord friendly”, and if you don’t follow the correct procedure you can be scrood.

Take this for what it’s worth. If i had a trespassor standing inbetween me and $$$, I would, or me and several large friends would, gain control of my property…Then i would light the exterior up. What if these people get hurt in your property. Get insurance and get them out. Loud noises in the am may help.

Didn’t you inspect the property prior to purchasing/closing? Not an expert in this area, but if they are trespassing the police should arrest them if they don’t leave. I would contact the authorites again and go to the top if you have to. It sounds like the court and the police are both passing the buck.

Thanks for the advice, but I think that we will just have them arrested on trespassing charges and face the consequences later. Hey, if they have the nerve to be squatters let them sue me.
