If the quitclaim deed has the verbage “as joint tenants” just after the names on the deed, your husbands share will go to the brothers. If not, the ‘partnership’ is viewed as “tenants in common” and your husbands share will remain with his estate.

My mother in law quit claimed her land to my husband and his brothers. My question is this. If something happened to my husband and he passed away before his mother, would his share of the quit claim be transferred to his estate or does it return to the other three brothers? Thanks for your help in this matter.
