Hey all-

I have a rent to own tenant buyer ready to cash me out…

Her mortgage broker is stating that we need to change the option agreement into a Land contract and back date it, so in essence the buyer will be refinancing the property. It’s alot easier to get her to purchase the property this way, according to him. I understand where he is coming from, but what ramifications does this have on me?

Couple of things…

  1. If for some reason, she does not get approved I have this signed Land contract sitting out there and the tenant buyer could sue me and state that she owns the property, although nothing was ever recorded.

  2. Does this mean NO closing costs for me since this is a refinance and not a purchase?

I just don’t like the idea of back dated stuff on paperwork…

any thoughts…

Some lenders can treat a lease purchase deal as a refinance.

They might be hard to find in your area, but they are out there.

This sounds like something that could get you into a lot of trouble. Tell your buyer to find a different (honest) broker.
