You and the family members are not supposed to control, i.e. have less than 50% ownership. You can own 100% of an LLC if you don’t control. The most recent approach is Sage Int’l using an LLC formed within the IRA to allow you to direct investments. There is still the problem even in that approach of UBI when doing leveraged deals.

Can a self-directed IRA invest in an LLC that is made up of yourself and family members? The LLC would invest in rental properties and notes. If so, is the IRA considered a “member” ?
