The Federal Privacy Laws are pretty strict. Do a google search on them and see what you turn up.

I have a situation and I was wondering if anyone knows where I can find a definitive answer.

In every case I’ve ever dealt with, the lenders will NOT talk to a borrower’s spouse if the spouse is not also on the note without a third party authorization signed by the borrower.

Is that the law, or is that just how most lenders are handling it?

If there are any other federal laws that impact confidential, financial information, I would love to hear about it.

Thank you!

I don’t see where the FDCPA plays into it. A lender is not a “debt collector” under the act. There are some states that include original creditors under there consumer collection laws though.
