Not sure about where you’re at or the specifics of your contract, but here (Chicago) we generally use a contract (or rider) that states a fax copy is as binding as an original.

SIGNED FAXED CONTRACT …STILL VALID AND LEGAL? - Posted by Jeff

Is a contract legal and valid if there is no actual
copy with both original signatures? For instance an agreement that was signed by the buyer and then faxed to the seller, and then faxed back with both signatures? So that there is no actual copy with both original signatures. Weird question but I’m in the middle of a dispute. Thanks.

Since the buyer used the fax to transmit the offer and the seller used it to relay his acceptance, it’s obvious that both parties intended that the fax copy be binding. Therefore it is, with or without language in the contract specifying same. Today, most court’s routinely accept fax signed doucments. Signed originals are important if it’s necessary to prove the authenticity of signatures, since handwriting experts have a difficult time analyzing photo or fax copies.
