Get it signed up and then have an attorney make sure all the hoops get jumped through. What you really want is a deal and some time from the lender.

Hi all,

I have run into a foreclosure that is 14 days from the auction. I am meeting with the husband tomorrow.

The problem that has come up is that his wife has a mental disability. She has dementia. I asked the husband how he plans to get around this.(we need her signature) He told me that he is her gaurdian and that she can still sign her name.

What pitfalls should I look for? I will inist on documentation that states he is the legal gaurdian. I don’t want to do this deal only to have it all be taken away.

If he can’t give me that documentation should I just walk away or try to get it at the foreclosure auction?

In FL which I assume is similar to most states, if she is mentally disabled her guardian would need approval of the sale by a judge before he could sign for her on a deed even if he has been appointed.
