Subject 2 vs Contingent Upon - Posted by CaseyinBoise

“Subject to” is used in two ways:

1 - As a short form of “subject to the existing financing.” This means that you are taking over the payments for a loan, but not assuming the loan. When I talk about this I always use a hyphen, i.e., subject-to.

2 - The second way the term is used is in a legal sense. “Subject to the following:” means that the contract is conditional on the items listed being fulfilled or the occurrences happening. In this case, “subject to” is synonymous with “contingent upon.”

What are the differences between these two? Are the contracts basically the same?
Any examples of these two are SINCERELY appreciated.
Thanks in advance.
