Mobile home titles in Texas are administered by the Texas Department of Housing and Community Affairs.
The web site is : http://www.tdhca.state.tx.us/
The law controlling licensing is the Texas Manufactured Housing Standards Act, http://www.tdhca.state.tx.us/pdf/mh/mhlaw.pdf
The rules that Texas setup to administer the law are at: http://www.tdhca.state.tx.us/pdf/mh/MHrules.pdf
On page 61 of the MHrules.pdf
Chapter 80 Rules (Effective October 19, 1999) Page 60 of 98 Date Printed: 10/13/99 10:28 AM
(b) Retailer. Any person engaged in the business of buying for resale, selling, or
exchanging manufactured homes or offering such for sale, exchange, or lease
purchase to consumers shall be licensed as a retailer. An application for license shall
be submitted on the form required by the department and be completed giving all the
requested information. The application shall be accompanied by the required
security and payment of the license fee. No person shall be considered a retailer
unless engaged in the sale, exchange, or lease purchase of two or more manufactured
homes to consumers in any consecutive twelve (12) month period. Sales, exchanges,
or lease purchases by any employee or agent of a business entity are deemed to be
sales of the business entity. Each separate sales location which is not on property
which is contiguous to or located within 300 feet of a licensed sales location requires
a separate license and security.
****** Note from Allan, notice that the sale of two or more require a licence, thus you can only sell one without a license. Someone at the convention was convinced they could sell two. *****
The next class for licensing is May 20 - 22, 2002
The form and information for the class is at: http://www.tdhca.state.tx.us/pdf/MH/LECEnroll.pdf
I’m not a fan of big brother but the state can be very nasty if an unhappy client raises a rukus. I’ll be in the May class and dot my i’s and cross the t’s when it comes to the paperwork.
