Wholesales through Realestate Agents

Can someone give direction on working a wholesale flip through an agent. The ones I’ve delt with only will use their contract. Is it acceptible to use theirs and add my addendum with the “subject to assignment” clause? Thanks

Agent’s responsibility

A REA is obligated by his state law to represent his principal/client so only your agent can represent you and your best interests and sellers’ agents must represent sellers only.

If you’re presenting your offers through sellers’ listing agents those agents can only legally use their states’ forms…but no law says you’ve got to even talk to those agents and you could deal with, work exclusively with the sellers and refuse to even talk to their agents so you have the right to use whatever forms you choose.

If you present your form to a seller it can contain whatever terms you elect to use and seller would have the right to deal with you and your form then pay his agent (if any) whatever commission had been previously agreed in writing between them.
