Yes, legal title passes. It is just a form of seller financing. Land Contracts would result in only equitable title passing until your payoff agreement with the seller is reached.

It is possible that the due on sale clause could be exercised against you. That is where a land trust comes in. You can read about it in the articles section of this site.
