changing right of survivorship - Posted by Jan Golden

I hold a joint tenancy title with right of survivorship. Is it possible to remove the right of survivorship so that my ownership would go to my willed beneficiary?
If so, how is this done?
thank you

If the ROS is written into a deed, the most practical way is for all the title holders named in that deed to deed, with new deed, to whomever they want, as Joint Tenants WITHOUT ROS.

While it could be done by each devisee (grantees in the deed) in his/her own estate planning, the new deed would be far simpler and certain.

You should definitely have a lawyer do this, as it’s unauthorized practice of law for non-lawyer to draft a deed for someeone else…and having a competent lawyer do it, you’ll know the language is right for your state and it’s been done right.

can this be done without the other tenants agreement?
