Correct, but you cannot evict the tenant in possession until you get relief from the bankruptcy court stay.

If a prospective tenant who indicates he may have to file a Ch. 7 to get rid of a large IRS tax lien offers a co-signer to secure payments under a lease option, is this an acceptable “safety net” from being caught in his Ch. 7 creditors. That is, can I look to the guarrantor for payments even if a court puts a hold on the tenants assets?
