Thanks for sharing your experience Kristine. This form seems to be a pretty good place for a newbie to start. I’m sure I’ll develop a better format when I find an attorney for my team, but for now it’ll do.

I obtained a .pdf file of the California Realtor’s “Purchase Agreement and Joint Escrow Instructions” form RPA-CA complete with the “California Association of Realtors®” logo in the upper left hand corner and the little “Equal Opportunity Housing” logo on the bottom right.

My question is, can I use this form legally by just filling in the blanks or do I have to be a licensed Realtor®?

There is some confusion, IMO, about the CAR forms. They are
available to “members” but then on the actual forms it says that they
intended for use by everyone in the industry. When I asked agent
friends for the blank ones (back in the day before pdf files) they acted
as if they were all numbered and they would get in trouble for giving
one of theirs to me. My lawyer gave me an original and I xeroxed it.
(Another supposed no-no.). I always filled them out by hand. And so
did the agents then. Now the ones I see are fill-in pdf.

I gave up long ago on that contract. What a long winded, difficult to
comprehend, complicating thing that is. The only time to use it is
when you have no choice. That being said, escrow officers prefer it
because it’s combined contract with instructions.

I’m not a lawyer, although I’ve played one on stage a couple of times, but unless there’s a specific statement on the form forbidding I’d say go for it.

In TX the TREC forms are “promulgated” and the agents have to use them or face some sanctions.
