A contractor can place a lien on a property that work has been performed on and payment has never been received, these liens are Mechanic’s liens. The contractor can not place a lien on a home that no work has been performed on.

Questions:

  1. I’m in the state of Georgia and I was wondering could anyone and everyone place a lien on your property without written proof that you owe them? Read question 2

  2. If “Jim” was a contractor who failed to pay his subcontractors what he owed on a job for Sam, can the subcontractors place liens on Sam’s home?

In addition to placing liens on Sam’s house, could the subcontractors place liens on Jim’s home, Jim’s mother’s home, or anyone else’s home that is related to Jim? Furthermore, Jim’s name is not on the titles or deeds or mortgages to the other homes.

I’m just curious as to where Georgia Law draws the line.
