A property has been partitioned and auctioned under state law. The return at auction is less than what was owed on the properties. In a deficiency judgement in favor of the lender, will the partition (shares to each party involved as determined by the court) be the basis upon which the banks will demand payment from each party? Or would they continue to demand payments from the parties jointly?
