You’ll be glad to know that the answer here is “Not Entirely”… and if you conduct your business carefully and properly, it gets even better - the answer then becomes “NO”. And, to answer your final question, you don’t need to worry about being creative at all. All you need to do is study the law yourself… CAREFULLY, and not through some website (websites never provide the full extent of the law - even the state sponsored statute sites).

I’m investigating the possibility of entering the note business. I read something on a web site saying that in order to broker real estate notes in CA, you need a real estate license. Is that true? And if so, are there creative ways around this?
