It’s usually best to get the deed signed. Harder for them to back out. But with these deals, you have to go with the flow.

Sounds like you haven’t taken a course on Sub2, you’re just jumping in. The good courses lead you thru all that step by step and you won’t have to be asking elementary questions here. Invest the money.
