Does your title insurance policy address this issue? Contact your title insurance company and ask them what, if any, are their responsibilities in this. One more question, did you purchase an owner’s title policy? This is the part that protects your investment, not the lender’s.

We purchased our home in 1989. Recently due to a highway expansion and survey, at least according the the highway department our property lines as described are actually 40 feet to West. This also affected our neighbors. I have spent 3 years and and dollars to get the state of mn to recognize our boundary issues to no avail. What role if any would title insurance play in this matter?
