We are in a Title state. We file a lien when changing the title into the buyers name. The county sends the title back to us, the lender. Our lien information, our name and address, file number and date filed appear on the face of the title under “First Lienholder.” No lender will loan against the home without having the title to process. Anyone who sees the title knows immediately that a lien has been filed.

If we change the title into the buyers name and hold the title until the note is paid off, what is to prevent the buyer from borrowing against the title once they have built up equity?
