The former owners become tenants at sufferance. By code if they pay rent they have up to 30 days to move. If they do not pay rent then you can give a three day notice to pay to start the eviction process. My suggestion is to take them a copy of the trustee’s deed and a letter that says both pay and or leave.Take a witness and try to inspect the house.

In Texas, when a house is purchased at foreclosure and the homeowners are still in residence, how do you go about getting them out of the house. Do they become tenants and you evict?
