You can prepare them, or the buyer can prepare them or You can have the title company (if they are legally allowed in your state) or your attorney prepare the trust deed and note instruments that way you know you are being represented. If the buyers attorney prepares the docs then have them reviewed to make sure there are no “unusual” provisions or clauses in there out of the norm.

I will be carrying a second for the first time. My question is, who drafts the trust deed for the second, the seller and his broker, or does the title company do this?
